Terms & Conditions

Version 2026-10-15-fbs, last updated 15 October 2026. These Terms & Conditions govern your use of the Future Build Solutions website and client portal and any services we supply. Future Build Solutions is operated by Future Build Solutions Pty Ltd (we, us). By accepting these terms you agree to them on your own behalf and on behalf of the business you represent.

1. Our services

We provide business operations audits, diagnostics, advisory and implementation support to Australian businesses. Our work is general business advice based on the information you give us. It is not legal, accounting, taxation, financial product or investment advice, and it is not a substitute for advice from your own licensed advisers.

2. Price range and engagement

The audit fee is not fixed in advance. Before the audit we give you a broad price range for a business of your size, with a stated ceiling. We record the range shown to you at the time it is shown, and that ceiling applies to your engagement. Figures produced by the qualification form, Quick Diagnostic or valuation tool are indicative only and based entirely on information you supply.

3. Setting the fee after the audit; no obligation to pay

You pay nothing to start. We set your exact fee only after the forensic audit is complete, once we can show you the value we have identified. Value identified is our estimate of the opportunity in your business, based on the evidence you supply and stated assumptions; it is not a result, a forecast of profit or a guaranteed return. Your fee will never be more than (a) the value identified divided by 2.5, or (b) the ceiling of the range you were shown under clause 2, whichever is lower. We will show you the value identified, the top areas it comes from, and how the fee was calculated, before you decide.

You have no obligation to pay unless you accept the fee. If you accept, we record your name, the date and time and your IP address, the fee becomes payable, and the full report is released once payment is made (or as otherwise agreed in writing). If you decline, nothing is payable and the full report is not released. Instalment plans may be offered at our discretion and are agreed in writing beforehand. Invoices are payable within the period stated on the invoice; overdue amounts may attract reasonable recovery costs.

3A. Our 2.5× Value Promise

Our 2.5× Value Promise. Your fee is never more than the value we identify divided by 2.5, and never more than the top of the range you were shown. You see the value and the fee before you decide. If you decline, you owe nothing. If you accept and pay, you can request a full refund within 30 days of payment.

To request a refund, email hello@futurebuildsolutions.com within 30 days of the date your payment (or, on an instalment plan, your first instalment) was received. We will refund every amount you have paid for the audit within 14 days of your request, and the licence in clause 7 ends. This is the only refund window for the audit fee; there is no separate performance or results-based refund test. This promise is in addition to, and does not limit, your rights under the Australian Consumer Law.

3B. GST

All price ranges and fees we show are in Australian dollars and include 10% GST. Where we show a fee we also show the GST-exclusive amount and the GST separately, rounded to whole dollars. Your tax invoice states the GST.

4. Your obligations

• Give us accurate, complete and timely information and access to the people and systems we need.
• Keep your portal credentials secure, and only invite people you authorise to see your business information.
• Make your own decisions about whether and how to act on our recommendations.

5. Confidentiality

We treat all client business information as strictly confidential. We disclose it only to personnel and contractors who need it to perform the work and who are bound by confidentiality obligations, or where the law requires disclosure. This obligation survives the end of the engagement. We will not publish your name or results as a case study or testimonial without your written consent.

6. Invited users

You may invite others (for example your accountant, managers or business partners) into your portal. You are responsible for who you invite and for removing access when it is no longer appropriate. Invited contributors give their own short undertaking — to keep the audit confidential, acknowledging our Privacy Policy and signing the Mutual NDA in their own name — and are not bound by, or liable under, the fee and payment clauses. Anything they contribute forms part of your business records with us.

7. Intellectual property

The Future Build Solutions audit methodology, ten-pillar framework, scoring model, report formats, software, brand and processes are the intellectual property of CBD Investment Group Pty Ltd and are licensed to Future Build Solutions operators under franchise agreement. No right, title or licence in that intellectual property passes to you except the limited right to use your own report for your own business. You must not copy, adapt, resell or reverse-engineer any of it. On payment in full you receive a perpetual, non-exclusive licence to use your deliverables inside your own business. Information about your business remains yours.

8. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), including that services will be supplied with due care and skill and be fit for any purpose made known to us. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, and other than for liability that cannot be excluded: our liability for any claim arising out of or in connection with the services is limited, at our option, to re-supplying the services or paying the cost of having them re-supplied, and in any event will not exceed the fees you have paid us for the relevant engagement. We are not liable for indirect or consequential loss, loss of profit, loss of revenue or loss of opportunity. We are not liable for outcomes that depend on your implementation of our recommendations, or for loss arising from information you gave us that was inaccurate or incomplete.

10. Cancellation

Either party may end an engagement in writing. If you cancel at any time before you accept a fee under clause 3, you owe nothing. After acceptance, the refund window in clause 3A applies to the audit fee. "Pay for work performed" applies only to implementation work agreed in writing after acceptance: if either party cancels that work, you pay for implementation work performed to that point, and if we cancel, only for work delivered and accepted.

11. Privacy

Our handling of personal information is governed by our Privacy Policy, which forms part of these terms and is available at futurebuildsolutions.com/privacy.

12. Dispute resolution

If a dispute arises, the party raising it must notify the other in writing describing the issue and the outcome sought. Both parties will then negotiate in good faith for 21 days. If it is unresolved, the parties agree to attempt mediation through the Australian Disputes Centre in Sydney, with costs shared equally, before starting court proceedings. Nothing in this clause prevents either party seeking urgent interlocutory relief, or you exercising rights under the Australian Consumer Law or complaining to a regulator.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

14. Changes

We may update these terms. The version number above changes when we do, and signed-in clients are asked to review and accept the updated version before continuing to use the portal. Changes do not affect the agreed scope or fee of an engagement already underway.
